Tenant Eviction

In order to legally evict a tenant you must follow strict procedure. If you do not follow the procedure carefully you could be accused of harassing your tenants. There are several legitimate reasons for evicting a tenant but it is required that you prove these reasons, some examples include;

• Rent Arrears and/or late rent payments
• Anti-social behaviour
• Disrepair
• The tenant has provided you with false information such as providing false references or fake credit card details
• Breach of contract such as smoking in property where smoking is not permissible or keeping pets.

The procedure for evicting a tenant can be very lengthy and requires extreme attention to detail; if procedure is not followed properly the tenant could accuse you of illegally evicting them. There are several steps that need to be taken including issuing a written notice to the tenant(s), applying to court for a possession order and knowing which type of notice to issue in accordance to the type of tenancy your tenant has.
