Revenge Eviction

Revenge Eviction – or Retaliatory Eviction – is when a landlord has attempted to evict you after you have made legitimate complaints or asked for repairs to be made to the property. Rather than fixing the issues reported, the landlord chooses to evict the tenant.

Until October 2015, this was not considered illegal; however the Deregulation Act issued that year made it illegal to evict someone out of revenge or retaliation.

Under the new rules if your landlord serves you a Section 21 Notice after you have complained about repairs or conditions at the property, the court may refuse to make a possession order against you if the following apply:

• You complained about repairs and/or conditions in writing
• Your landlord served you a Section 21 Notice after you complained
• You complained to the local authority
• The local authority sent a Notice of Improvement or a Remedial Action Notice to your landlord
