Asbestos

Asbestos is a potentially harmful substance that was used as a building material between the 1950s and 1980s and is likely to be present in most buildings built prior to 2000. Asbestos in a rented property can cause many problems and health risks. The substance was banned in 1999 because of its health risks. Provided the asbestos is maintained in a good condition it is unlikely to be harmful and can be considered safe, however, if it is damaged it can produce tiny dust particles which, if inhaled, can cause serious illness including lung cancer.

Asbestos can be found in many areas of a property, including;

  • Ceiling, door and wall linings
  • Central Heating Flues
  • Eaves and gutters
  • Floor Tiles
  • Garage and Shed Roofs
  • Insulation Panels

It is the landlord’s responsibility to ensure that all communal areas are fit for purpose and are hazard free. Landlords have a duty under the Defective Premises Act 1972 to take care to see that tenants and visitors are safe from personal injury or disease and although asbestos is not specifically mentioned it is included.

If you have reported asbestos to your landlord or a suspicion of asbestos and they do not take appropriate action then you may be entitled to compensation, especially if it is affecting your health.
